(Terms and Conditions)

1. Scope of Application

 

These GTC govern the contractual relationship between Hyseni Facility Management (hereinafter “Provider”) and its customers (hereinafter “Customer”) in connection with all services offered in the field of facility management, in particular cleaning, property maintenance, winter services, minor repairs, and other related services.
By commissioning or booking a service, the Customer acknowledges these GTC.

 

2. Conclusion of Contract

 

The contract is concluded through:

  • written or electronic acceptance of an offer,

  • a booking via the website,

  • written order confirmation, or

  • verbal agreement followed by execution of the service.

3. Services and Scope of Performance

The exact scope of services is defined in the service description within the offer, contract, or booking. Changes or additional services must be agreed upon in writing.
Types of services include in particular:

  • Regular cleaning

  • Special cleaning

  • Property maintenance

  • Outdoor cleaning and winter services

  • Minor repairs and immediate interventions

  • Handover and quality inspections

4. Prices and Payment Terms

The prices agreed upon at the time of contract conclusion shall apply. All prices are stated in Swiss Francs (CHF), excluding VAT, unless otherwise indicated.

Payment terms:

  • Invoices are payable within 10 days from the invoice date.

  • In case of late payment, a reminder will be issued; reminder fee CHF 20.

  • The Provider reserves the right to charge default interest of 5% p.a.

5. Rescheduling and Cancellations

Private Customers:

  • Free cancellation up to 24 hours before the appointment.

  • Thereafter, the full amount or a flat fee of CHF 80 will be charged.

Business Customers:

  • The individually agreed termination and cancellation periods shall apply.

  • Terminations must be made in writing.

6. Obligations of the Customer

  • Access to the premises must be ensured.

  • Damages or special circumstances (sensitive materials, etc.) must be reported in advance.

  • In the case of key handover, a documented key receipt will be issued.

7. Liability

Hyseni Facility Management shall only be liable for direct damages caused by gross negligence or intent.

No liability shall be assumed for:

  • damages caused by improper use by third parties,

  • normal wear and tear,

  • damages to improperly installed or unstable objects.

8. Data Protection

The collection and processing of personal data is carried out in accordance with our Privacy Policy, which forms an integral part of these GTC.

9. Jurisdiction and Applicable Law

Exclusively Swiss law applies, excluding international treaties (e.g., CISG).
Place of jurisdiction: the registered office of Hyseni Facility Management, Schifflände 26, 8001 Zurich, unless another statutory place of jurisdiction is mandatory.

10. Severability Clause

Should individual provisions of these GTC be wholly or partially invalid, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by one that is as economically equivalent as possible.
